Terms of Use

These terms govern your use of MedivaScan. Please read them before using the site. Last updated: May 31, 2026.

1. Acceptance of these terms

By accessing or using MedivaScan, you agree to these Terms of Use. If you do not agree, do not use the site. We may update these terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the site after that date means you accept the updated terms.

2. About this service

MedivaScan is an independent information service that displays public data published by the U.S. Food and Drug Administration (FDA), including adverse event reports, recall notices, drug shortage records, structured product labels, and the National Drug Code Directory. We compile, format, and present that public data so it is easier to search and read.

We are not the FDA. We are not affiliated with the FDA, HHS, NIH, or any other government agency. We are not a healthcare provider, doctor, nurse, pharmacist, pharmacy, hospital, or clinic. We do not diagnose, treat, prescribe, dispense, or counsel.

MedivaScan does not provide medical advice. Nothing on the site is a substitute for advice from a licensed healthcare professional. Do not use MedivaScan to decide whether to start, stop, change, or skip any medication. For any medical question, talk to your doctor, pharmacist, or another qualified healthcare provider. 3. Information you provide

MedivaScan does not require an account. You can use the site without giving us any personal information. We offer three public forms: a contact form, a correction form, and a drug-suggestion form. When you submit one of these forms, we receive the information you type in plus limited technical data needed to fight spam.

Our handling of that information is described in our Privacy Policy. Please do not send us protected health information, personal medical records, or information about other people without their permission.

4. Prohibited uses

You agree not to do any of the following:

  • Scrape, crawl, or otherwise access the site in a way that places an unreasonable load on our infrastructure or interferes with normal operation.
  • Submit data to our forms through automated means, scripts, or bots. The forms are for people. Bulk or automated submissions outside the public forms are not permitted.
  • Impersonate another person or organization, or provide false, misleading, or fraudulent information in a form submission.
  • Use the site, or information from the site, to give medical advice, treatment recommendations, or clinical opinions to other people.
  • Interfere with, disable, bypass, or attempt to circumvent any security feature of the site, including Cloudflare Turnstile, rate limits, honeypot fields, or access controls.
  • Use the site for any purpose that is unlawful, infringing, or harmful to others.

5. Intellectual property

The underlying FDA data shown on MedivaScan consists of works of the U.S. Government and is in the public domain in the United States. You can use that underlying data freely under applicable law.

However, the way we organize, present, and explain that data is our own work. Our compilation, page layouts, written summaries, computed answer blocks, navigation, search experience, software code, and design are the property of The Consistent Co LLC and are protected by copyright and other intellectual property laws.

MedivaScan and any associated logos, marks, and trade dress are trademarks of The Consistent Co LLC. You may not use them in a way that suggests endorsement or affiliation without our written permission.

You may quote short excerpts from our pages for reference, commentary, or journalism, provided you give clear attribution to MedivaScan and link back to the page you are quoting. You may not republish bulk content from the site, copy our pages wholesale, or create a derivative directory from our compiled material.

6. No warranty

MedivaScan is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness.

We do not warrant that the information on the site is accurate, current, complete, or suitable for any purpose, including any medical, clinical, diagnostic, treatment, research, or regulatory purpose. FDA source data can contain errors, omissions, and delayed updates. Adverse event reports in FAERS are unverified reports of suspected associations and do not establish that a drug caused a given outcome. You are responsible for verifying anything you rely on with primary sources and a qualified professional.

7. Limitation of liability

To the maximum extent permitted by law, The Consistent Co LLC, its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, MedivaScan, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or related to MedivaScan or these terms will not exceed the greater of (a) one hundred U.S. dollars ($100 USD) or (b) the amount you paid us in the twelve months before the event giving rise to the claim. Visitors do not pay MedivaScan, so this cap effectively floors at $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest amount permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless The Consistent Co LLC and its members, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the site, your violation of these terms, your violation of any law, or your infringement of any third-party right.

9. Third-party links and references

MedivaScan links to the FDA, sources cited by the FDA, and other third-party sites. We provide those links as a convenience. We do not control those sites, we do not endorse their content, and we are not responsible for their accuracy, availability, or practices. When you visit a third-party site, your use of that site is governed by that site's own terms and privacy policy.

10. Termination

We may block, suspend, or restrict your access to MedivaScan at any time, with or without notice, if we believe you have violated these terms or misused the site. You may stop using the site at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

11. Changes to these terms

We may revise these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be reflected on this page. Your continued use of the site after the changes take effect means you accept the revised terms.

12. Governing law and venue

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these terms or your use of MedivaScan will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

13. Severability and entire agreement

If any provision of these terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These terms, together with the Privacy Policy and the Medical Disclaimer, are the entire agreement between you and The Consistent Co LLC regarding your use of MedivaScan, and supersede any prior agreements on the same subject.
